At a glance
A plain-language summary. The numbered clauses below are what legally applies.
- Using WeGrowNepal means you accept these Terms, the Privacy Policy and the Acceptable Use Policy.
- Reading and downloading are free and need no account. An account is needed to upload, post or save.
- What you upload stays yours. You give us a licence to host and show it; you do not give us ownership.
- You may only upload material you actually have the right to share.
- Unreleased examination material is the one breach that ends an account immediately and may be reported.
- There is no tolerance for objectionable content or abusive users. Report anything; we act within 24 hours.
- The service is provided as is. Our liability is limited, and Nepali law governs any dispute.
1. Acceptance and scope
- 1.1
By accessing wegrownepal.com, the WeGrowNepal mobile application, or any related service (together, the "Service"), you accept these Terms of Use and agree to be bound by them.
Why this is here
Acceptance is by use. You do not have to click anything for these Terms to apply, which is why they are linked from every page of the site.
- 1.2
If you do not agree to these Terms, you must not access or use the Service.
- 1.3
The Service is operated by Lacspace Corporation Pvt. Ltd. ("Lacspace", "we", "us", "our"), a company registered in Nepal under registration number 377566/82/83, with its registered office at Bhimsengola, Sinamangal, Kathmandu, Bagmati Province, Nepal.
- 1.4
WeGrowNepal is a product of Lacspace. References to "the Service" include the website, the mobile applications, the public API where offered, and any successor or related service we publish under the same name.
- 1.5
These Terms incorporate by reference the Acceptable Use Policy, the Community Code of Conduct, the Privacy Policy, the Copyright and Intellectual Property Policy, the Academic Integrity and Examination Material Policy, and every other document published in the Legal Centre.
Why this is here
Incorporation by reference means those documents bind you as if they were printed here. It keeps this document readable without narrowing what applies.
- 1.6
Where these Terms conflict with a specific policy on a matter that policy governs, the specific policy prevails on that matter and these Terms govern everything else.
- 1.7
The version of each document published in the Legal Centre is the authoritative version. Downloaded PDF copies are controlled copies provided for convenience and reference.
- 1.8
We may publish additional terms for particular features. Where we do, those additional terms apply to that feature in addition to these Terms.
2. Eligibility and accounts
- 2.1
You may read and download material on the Service without an account. Uploading, posting, commenting, voting and saving require a free account.
- 2.2
You must be at least 13 years old to create an account. If you are under 18, you may only create an account with the knowledge and permission of a parent or legal guardian.
Why this is here
This is a study platform used largely by school and college students, so a realistic minimum age matters more here than a legally convenient one. The Child Safety and Protection of Minors Policy sets out what else applies to accounts held by people under 18.
- 2.3
You must provide accurate registration information and keep it current. Accounts registered with information you know to be false may be suspended.
- 2.4
You are responsible for keeping your password confidential and for all activity that occurs under your account.
- 2.5
You must notify us at abuse@lacspace.com as soon as you become aware of any unauthorised access to or use of your account.
- 2.6
You may not sell, rent, share or transfer your account to another person, and you may not create an account on behalf of someone else without their authority.
- 2.7
One person may hold one account. Creating additional accounts to evade a suspension, inflate contribution counts, or manipulate votes is a breach of these Terms.
- 2.8
We may refuse to create, or may close, an account where we reasonably believe it exists to breach these Terms.
- 2.9
You may close your account at any time from the account deletion page. Closure is governed by the Data Retention and Deletion Policy.
3. Cost, availability and changes to the Service
- 3.1
The Service is provided free of charge. There is no subscription, no paid tier, no trial that expires, and no feature that requires payment to unlock.
- 3.2
We do not display advertising on the Service and we do not sell access to your reading, your account or your data.
- 3.3
The Service has no checkout. Neither the website nor the application asks for payment card details or processes payments.
Why this is here
Stated explicitly because it is the fastest way for a reader to identify a phishing site imitating this one. If a page bearing this name asks for a card, it is not ours.
- 3.4
Voluntary donations may be arranged directly with the Lacspace team. Donations are gifts. They buy no additional rights, features, ranking, visibility or influence over moderation.
- 3.5
We do not guarantee that the Service will be available without interruption or free from error. It may be unavailable for maintenance, for technical reasons, or for reasons outside our control.
- 3.6
We may add, change, suspend or withdraw features at any time. Where a change materially reduces functionality you rely on, we will give reasonable notice where it is practical to do so.
- 3.7
We may impose reasonable limits on storage, file size, upload frequency, request rate or bandwidth to keep the Service usable for everybody.
- 3.8
We may discontinue the Service entirely. If we do, we will give at least thirty days' notice on the site where practicable, and provide a means to export the material you contributed.
Why this is here
A free service closing without warning is how student work is lost. Committing to notice and an export route is the point of this clause.
4. Your content
- 4.1
"Your Content" means anything you upload, post, submit or transmit through the Service, including notes, documents, images, questions, answers, comments and profile information.
- 4.2
You retain ownership of Your Content. Nothing in these Terms transfers copyright or any other proprietary right in Your Content to us.
- 4.3
By submitting Your Content you grant us the licence set out in the Contributor Licence Agreement, which is the document that governs what we may do with it.
- 4.4
You represent and warrant that you own Your Content or otherwise have all rights necessary to submit it and to grant that licence.
Why this is here
This is the clause that matters most in practice. Uploading a scanned textbook is not permitted by the copyright holder, and this representation is what makes that your breach rather than ours.
- 4.5
You are solely responsible for Your Content, including its accuracy, its legality, and any consequence of publishing it.
- 4.6
You must not submit content that infringes any third party's copyright, trademark, moral rights, privacy rights, confidence or any other right.
- 4.7
You must not submit content containing another person's personal information — including marksheets, citizenship numbers, addresses or telephone numbers — without that person's informed consent.
- 4.8
Your name is credited on what you contribute and remains attached to it while it is published, which is the only compensation contributors receive.
- 4.9
You may request removal of Your Content at any time. Removal is handled under the Data Retention and Deletion Policy.
- 4.10
We may remove, restrict, reclassify or refuse any content at our discretion where we reasonably consider it breaches these Terms or any incorporated policy, or where we are required to do so by law.
5. Our content and rights
- 5.1
The Service itself — including its source code, design, interface, database structure, brand, name, logo and all associated materials — is the exclusive property of Lacspace Corporation Pvt. Ltd. and is protected by copyright, trademark and other laws.
- 5.2
The Service is licensed to you for personal, non-commercial use. It is not sold to you, and no ownership passes to you.
- 5.3
You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Service in accordance with these Terms.
- 5.4
You may download material from the Service for your own study and may share it with other students for the same purpose, provided attribution to the contributor is preserved.
- 5.5
You may not republish material collected from the Service as a compilation, a competing library, a paid resource, or a coaching product, whether or not you charge for it.
Why this is here
Individual notes are shared freely on purpose. The library as a whole — the collection, its organisation and its metadata — is not free to lift.
- 5.6
You may not systematically extract, scrape, crawl, mirror or index the Service or any substantial part of it without our prior written permission.
- 5.7
You may not use the Service, its content or its metadata to train, fine-tune or evaluate any machine learning or artificial intelligence model without our prior written permission.
Why this is here
Stated expressly because contributors uploaded their notes for students to read. Silence on this point would be read as consent.
- 5.8
Our name, logo and brand may only be used in accordance with the Brand and Trademark Use Policy.
- 5.9
All rights not expressly granted in these Terms are reserved.
6. No tolerance for objectionable content or abusive users
- 6.1
WeGrowNepal has no tolerance for objectionable content or for abusive users. This is not a preference. It is a condition of using the Service, and you accept it when you create an account.
- 6.2
Objectionable content includes, without limitation: sexual or pornographic material; nudity; graphic violence or gore; content that encourages self-harm or suicide; hate speech or content attacking a person or group on the basis of caste, ethnicity, religion, gender, sexuality, disability or origin; harassment, bullying, threats and intimidation; content that sexualises a minor in any way; and content promoting illegal acts.
- 6.3
An abusive user is any person who directs the conduct above at another person, whether once or repeatedly, and whether or not the target is a member of this community.
- 6.4
You may report any content or any account, from the app or the website, at the point where you encounter it — on a note, a post, a comment or a profile. Reporting is available to every signed-in person and does not require a reason to be proven.
Why this is here
A report is not a public accusation. Nobody is told who reported them.
- 6.5
You may block any account. Blocking removes that person's notes, posts and comments from everything you see, immediately and everywhere, and prevents them from reaching you. A block also notifies our moderators, so that a pattern of blocks is visible to us even where nobody has filed a report.
- 6.6
We review reports of objectionable content and abusive behaviour within 24 hours of receipt. Where a report is upheld we remove the content and, where the breach warrants it, terminate the account that posted it and refuse that person further use of the Service.
Why this is here
Content reported by enough separate people is hidden automatically before a moderator reaches it, so the 24 hours is an upper bound on human review rather than on the content staying visible.
- 6.7
Attempting to evade a block, a suspension or a termination — including by creating a further account — is itself a breach, and ends every account involved.
- 6.8
Nothing in this section limits any other remedy available to us or to the person affected, including reporting a matter to the Nepal Police or to any other competent authority.
7. Prohibited conduct
- 7.1
You must comply with the Acceptable Use Policy in full. The clauses in this section are a summary of the most serious prohibitions and do not limit that policy.
- 7.2
You must not upload, post or share any examination paper, question or answer that has not yet been sat by all candidates.
Why this is here
This is the single most serious breach possible on this platform. It devalues the qualification of every student who revised honestly, and it exposes both the uploader and this service to action by examination authorities.
- 7.3
You must not upload scanned textbooks, purchased coaching material, or any other work you do not have the right to distribute.
- 7.4
You must not harass, threaten, defame, impersonate or abuse any person, or incite others to do so.
- 7.5
You must not upload malware, attempt to gain unauthorised access to any system or account, probe or test the security of the Service except as permitted by the Security and Vulnerability Disclosure Policy, or interfere with its operation.
- 7.6
You must not use automated means to create accounts, cast votes, inflate download or view counts, or otherwise manipulate any ranking or metric on the Service.
- 7.7
You must not use the Service to advertise, solicit, recruit or sell, including selling notes, answers, assignments, or a service to sit an examination on someone else's behalf.
- 7.8
You must not misrepresent the origin of material, including presenting another student's work as your own.
- 7.9
You must not use the Service for any purpose that is unlawful under the laws of Nepal or under the laws applicable where you access it.
8. Moderation, suspension and termination
- 8.1
We operate the moderation and enforcement process set out in the Enforcement, Warnings and Legal Action Policy.
- 8.2
We may remove content, restrict features, suspend an account or close an account where we reasonably believe these Terms or an incorporated policy has been breached.
- 8.3
Where proportionate, enforcement begins with removal and a notice explaining what was removed and which rule it engaged.
- 8.4
Breaches involving unreleased examination material, child safety, credible threats of violence, or unauthorised access to systems result in immediate closure without a prior warning.
- 8.5
You may appeal any enforcement decision under the Grievance and Complaints Policy.
- 8.6
We may preserve and disclose content and account records where we are required to by law or where disclosure is reasonably necessary to protect a person from harm, in accordance with the Law Enforcement and Legal Requests Policy.
- 8.7
Closure of your account does not automatically remove content you contributed. Removal of contributed content is dealt with in the Data Retention and Deletion Policy.
Why this is here
Notes other students are relying on for an examination are not withdrawn silently the moment an account closes. The retention policy sets out exactly what is kept, what is anonymised and what is deleted.
- 8.8
You may stop using the Service at any time. Sections that by their nature survive termination — including intellectual property, disclaimers, liability, indemnity and governing law — continue to apply.
9. Disclaimers
- 9.1
The Service and everything on it is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, to the fullest extent permitted by law.
- 9.2
Material on the Service is written and uploaded by students. It is not verified, endorsed, examined or approved by us, by any examination board, by any university, or by any government body.
- 9.3
Material on the Service is not an official syllabus, an official past paper, or an authoritative statement of any curriculum. You must check anything you rely on against your own current official syllabus.
Why this is here
Set out in full in the Disclaimer and Limitation of Liability document. It appears here because it is the single most likely cause of loss to a reader, and burying it would be indefensible.
- 9.4
We do not warrant that material on the Service is accurate, complete, current, or fit for any particular purpose, including preparation for any examination.
- 9.5
Nothing on the Service is legal, financial, medical or professional advice.
- 9.6
We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that defects will be corrected.
- 9.7
Links to third-party sites are provided for convenience. We do not control and are not responsible for their content, policies or practices.
10. Liability and indemnity
- 10.1
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profits, revenue, data, goodwill, opportunity or academic result.
- 10.2
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the greater of the amount you have paid us for the Service — which is ordinarily nil — or NPR 5,000.
Why this is here
A liability cap on a free service is common, and its enforceability against a consumer in Nepal is not something either party should assume. Nothing in this section limits liability that cannot lawfully be limited, including for death, personal injury or fraud.
- 10.3
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited.
- 10.4
You agree to indemnify and hold us harmless against any claim, demand, loss, liability, cost or expense — including reasonable legal fees — arising from Your Content, your use of the Service, or your breach of these Terms or of any law.
- 10.5
Our obligations under this agreement are suspended for as long as performance is prevented by an event beyond our reasonable control, including power failure, network failure, natural disaster, civil disturbance or governmental action.
11. Changes to these Terms
- 11.1
We may amend these Terms. The current version, its version number and its effective date are always published in the Legal Centre.
- 11.2
Where an amendment materially affects your rights or obligations, we will give notice on the Service before it takes effect, and where you hold an account we will give at least fourteen days' notice.
- 11.3
Amendments required by law or necessary to address a security or safety risk may take effect immediately.
- 11.4
Every version of every document carries a version history recording what changed and when, so that amendments can be inspected rather than taken on trust.
Why this is here
A policy that can be rewritten silently is not a commitment. The version history is what turns it into one.
- 11.5
Continuing to use the Service after an amendment takes effect constitutes acceptance of the amended Terms. If you do not accept them, you must stop using the Service and may close your account.
12. General
- 12.1
These Terms are governed by the laws of Nepal.
- 12.2
You and we submit to the exclusive jurisdiction of the courts of Kathmandu, Nepal, save that we may bring proceedings to protect our intellectual property in any competent court.
- 12.3
Before commencing proceedings, both parties will attempt in good faith to resolve the dispute through the Grievance and Complaints Policy. This does not prevent either party from seeking urgent interim relief.
- 12.4
If any provision of these Terms is found to be unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in full force.
- 12.5
Our failure to enforce any provision is not a waiver of it, and no waiver is effective unless given in writing.
- 12.6
You may not assign or transfer your rights under these Terms. We may assign ours to an affiliate or to a successor in connection with a reorganisation, merger or sale of the business.
- 12.7
These Terms, together with the documents they incorporate, constitute the entire agreement between you and us in relation to the Service and supersede any prior understanding.
- 12.8
These Terms do not create any partnership, agency, employment or joint venture between you and us, and confer no rights on any third party.
- 12.9
Notices to us must be sent to legal@lacspace.com and, where formal service is required, to Lacspace Corporation Pvt. Ltd. at Bhimsengola, Sinamangal, Kathmandu, Bagmati Province, Nepal.
- 12.10
These Terms are published in English. Any translation is provided for convenience, and the English version governs in the event of any inconsistency.
